REGULAR TOWN COUNCIL MEETING
January 25, 2021
MINUTES
(These minutes are not a verbatim transcript, but rather the attempt of the Clerk to capture the intent of the speaker. All votes were taken via Roll Call Vote.)
1. Call to Order
Mayor Glenn Levy called the meeting to order at 6:32 p.m. The meeting was held virtually through GoToMeeting.
2. Roll Call
Present: Glenn Levy, Mladenka Boehrer, Chelsea Steen, Kathleen Bailey, Sean Davis, Melissa Jacobi, and Adam Ellsworth. A quorum was established.
Staff in attendance: Town Attorney Erin King, Court Clerk Beverly Seidel, Police Chief Steve Davis, Public Works Director Gene Bird, and Town Clerk Sarah Albright.
Mayor Levy stated the rules and procedures for the meeting.
3. Consent Agenda
Boehrer made a motion to approve the Consent Agenda, which consisted of the Summary Account Information & Accounts Payable for December 2020. It was seconded by Ellsworth. With all those present, voting yes, the motion carried.
4. Unscheduled Public Comment
None.
5. Staff Reports
Municipal Courts
Court Clerk Beverly Seidel stated that the quarterly report was finished for 2020. Tickets were up. She stated she is being trained on Cassell court software. She is working on collections. The judge left after eight years. Mayor stated interviews would probably take place in March for a new judge. Seidel stated that it has been difficult working part-time in the home office due to COVID and part-time in the Town office.
Public Safety
Police Chief Steve Davis stated his report was included in the Agenda packet. He highlighted the training his officers recently received regarding COVID, driving on ice, strangulations in domestic violence cases, and the no chase-pursuit rules in place. He also spoke about notification regarding abandoned vehicles and shopping carts. He reported that 100% of his team is vaccinated and many have already received their second dose.
Public Works
Director Gene Bird stated his report was included in the Agenda packet. He stated the Council will talk about trash can issues tonight. Possible funding for a stormwater project to help repair the pipe at 44th & Ames and possible repair some curb and gutters in the area is available through the State. He stated he would be coming back to Council for approval to apply for the grant funds.
Town Clerk
Sarah Albright stated she is getting some temporary help tomorrow. She stated she is on the mend and getting better, although she is not 100% as of yet.
Town Attorney
No report.
6. Public Comment on Agenda Items
Geneva Kowalski – resident, asked Council for more information about the ADUs and land use issues. She also asked for a better copy of the Town’s Development Plan. She received one from SafeBuilt which was hard to read.
7. SECOND READING OF ORDINANCE NO. 2020-12-21, AN ORDINANCE AMENDING SECTIONS 16-4-32 AND 16-5-32 RELATING TO ACCESSORY STRUCTURES
Evan King summarized the ordinance. Steen made a motion to adopt Ordinance 2020-12-21. It was seconded by Boehrer. With all those present voting yes, the motion carried.
8. DISCUSSION AND POSSIBLE APPROVAL OF RESOLUTION NO. 2021-01-25A, A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN MARK’S QUALITY LAWN & TREE AND THE TOWN OF MOUNTAIN VIEW FOR SIDEWALK, LAWN, TRASH, AND PARK LAND MAINTENANCE.
Mayor Levy explained that this is a contract and the Mayor added a few trash pick up locations to the list. Bailey stated her concern about the type of weed control being used and wanted to be sure it was environmentally-friendly. She was also concerned about the cost increase. Bird stated that he could not remember the name, but the brand was environmentally-friendly.
Bailey made a motion to postpone the discussion until all her questions could be answered and vote on this item at the February meeting. It was seconded by Boehrer. With all those present voting yes, the motion carried.
9. DISCUSSION AND POSSIBLE APPROVAL OF RESOLUTION NO 2021-01-25B, A RESOLUTION SPECIFYING THE OFFICIAL PUBLIC NOTICE LOCATION.
Boehrer made a motion to adopt Resolution 2021-01-25B. It was seconded by Bailey. With all those present voting yes, the motion carried.
Mayor recessed the meeting at 7:10 p.m. and reconvened at 7:22 pm.
10. DISCUSSION OF ACCESSORY DWELLING UNIT MAXIMUM SIZE LIMITS AS SPECIFIED IN CHAPTER 16 OF THE TOWN OF MOUNTAIN VIEW MUNICIPAL CODE
Mathew Nilson of SafebuiltStudio gave a PowerPoint presentation on this item. Nilson stated the previous discussion on the Agenda was for non-residential accessory units, not dwelling units. His presentation was included in the Agenda packet.
The presentation included definitions of Accessory Buildings and Accessory Dwelling Units; Current Standards; Peer Community Standards; Considerations; and Proposal Options to Increase Size. Discussion ensued amongst Council members.
Mayor Levy wrapped it up stating that 50% of council wants things to remain as is.
11. DISCUSSION OF THE RESIDENTIAL CONSTRUCTION HEIGHT LIMITS IN THE R-2 AND R-3 ZONING DISTRICTS IN CHAPTER 16 OF THE MOUNTAIN VIEW MUNICIPAL CODE
Mathew Nilson of SafebuiltStudio gave a PowerPoint presentation regarding this item.
The presentation was included in the Agenda packet. The presentation included: Current Residential Standards; Heights and Comparative Tables and Considerations, Definitions of Building Base and Building Heights.
Discussion ensued amongst Council members, primarily council stating concern over structures being too high in R-2 and R-3 zones and the water table in Mountain View.
12. DISCUSSION OF TRASH CAN OPTIONS
Adam Ellsworth presented pricing for trash cans from GFL and Rehrig and discussed the options with Council. Details will be finalized at a later time.
13. COMMITTEE UPDATES
Committee reports were included in the Agenda packet.
14. MAYOR’S REPORT
Mayor Levy stated that a special meeting will need to be held in order to approve a resolution and application for the stormwater grant. Publication of public hearing must be done five days in advance. Mayor set a special meeting to be held at 6:30 pm on February 3, 2021.
Levy stated he believed COVID vaccines for elected officials will happen in late Spring. In-person meetings will not happen before mid-summer.
Mayor stated that committee meeting attendance is important.
15. COUNCIL MEMBERS’ REPORTS/ITEMS
None.
16. ADJOURNMENT
Ellsworth made a motion to adjourn the meeting. It was seconded by Bailey. Mayor Levy adjourned the meeting at 8:57 p.m.
