TOWN COUNCIL MEETING MINUTES

April 19, 2021

6:30 PM

PRESENT: Mayor Pro Tem Chelsea Steen, Councilmembers Kathleen Bailey, Mladenka "Mia" Boehrer, Sean R. Davis, and Melissa Jacobi.

STAFF MEMBERS PRESENT: Gene Bird, Public Works Director; Steve Davis, Chief of Police; Beverly Seidel, Court/Police Department Clerk

  1. CALL TO ORDER AND ROLL CALL

    Mayor Pro Tem Chelsea Steen called the meeting to order, and Temporary Town Clerk Shelly Clark called the roll.

  2. CONSENT AGENDA

    Councilmember Jacobi moved and Councilmember Bailey seconded to approve the items on the consent agenda:

    Meeting Minutes for March 15, 2021 Regular Meeting and Meeting Minutes for March 22,2021 Special Meeting.

    Roll Call Vote: Bailey-- Yes; Boehrer--Yes; Davis--Yes; Jacobi--Yes. The motion passed.

  3. UNSCHEDULED PUBLIC COMMENTS-COMMENTS ARE LIMITED TO 3 MINUTES

    Mayor Pro Tem Steen asked if there were any unscheduled comments from the public. There were none.

  4. PROCLAMATION-NATIONAL CRIME VICTIM'S RIGHTS WEEK APRIL 18-24, 2021.

    Mayor Pro Tem Steen presented Council's Proclamation supporting National Crime Victim's Rights Week April 18-24, 2021.

  5. STAFF UPDATES AND REPORTS

Reports on the Town's departmental operations were given:

Municipal Court Clerk-- Beverly Seidel referred to her report in the Agenda Packet, by giving an update on the collection process that has been put into place by contracting with Bushwood Capital Group. Ms. Seidel informed Council that Mountain View recently conducted their first court session in five months, with Judge Kline doing a fantastic job. Ms. Seidel updated Council on the new Court software they are using from Caselle.

Public Safety — Chief Davis referred to his report in the Agenda Packet, pointing out to Council that Officer McElroy has conducted over $60,000 worth of VIN Inspections for the Town. He stated that there has been an increase in the number of tickets issued for driving with no insurance and no license. Chief Davis reported that there was a death in Mountain View and that VOI (Victim Outreach Inc.) was a tremendous help in dealing with this issue. He updated Council on training sessions that the Police Department attended. Chief Davis also reported that the Department received an award for their policies management. This will help the Department move closer to receiving accreditation. He also gave Council updates on the coresponder's program, the testing of bodycams, and the inspection and cataloging of the evidence room.

Public Works— Mr. Bird referred to his report in the Town Council Agenda Packet, pointing out that the new speed sign is working well. Mr. Bird stated that the Sprinkler Doctor will be coming next week to get the sprinkler system ready for Spring. A plumber will investigate the sewer gas odor in the lads/s room at Town Hall. Repairs may be needed to correct the issue.

Town Attorney— No Report

Administration—Ms. Trotter updated Council on the services that Professional Management

Solution has provided to the Town of Mountain View in the absence of the Town's

Clerk/Treasurer Sarah Albright over the past ten weeks, including Accounts Payable, Cash Receipting (review of cash entries and preparing deposits), Payroll and correcting prior months payrolls, Utility Billing, and Advising Staff on Issues that have come up. Preparation for the 2020 financial audit by independent auditors will be delayed while these operational tasks take precedence.

Ms- Trotter left the meeting.

Temporary Town Clerk—Shelly Clark of Professional Management Solutions reported the tasks she has performed over the last couple of months related to recording Council meeting and minutes, filing the 2021 Adopted Budget with the Department of Local Affairs, attesting to Ordinances and Resolutions, processing contract paperwork for Judge Kline, processing requests for public records, working several days reviewing and organizing the Clerk's emails, and completing and finalizing the minutes from October 2020 to current.

6. PUBLIC COMMENTS REGARDING CURRENT AGENDA ITEMS

Mayor Pro Tem Steen asked if the public had any comments regarding current agenda items. There were none.

7. DISCUSSION AND POSSIBLE APPROVAL OF RESOLUTION NO. 2021-4-19A, A RESOLUTON APPOINTING SHELLY CLARK OF PROFESSIONAL MANAGEMENT SOLUTIONS AS TEMPORARY TOWN CLERK THROUGH JUNE 24, 2021.

Mayor Pro Tem Steen reviewed Resolution No. 2021-4-19A.

Councilmember Bailey moved and Councilmember Davis seconded the approval of Shelly Clark of Professional Management Solutions as Temporary Town Clerk through June 30, 2021.

Roll Call Vote: Bailey —Yes; Boehrer — Yes; Davis — Yes; Jacobi — Yes. The motion passed.

8. SECOND READING OF ORDINANCE NO. 2021-3-15A, AN ORDINANCE REPEALING AND

REENACTING BY REFERENCE A ZONING DISTRICT MAP OF THE TOWN OF MOUNTAIN VIEW Mayor Pro Tem Steen reviewed Ordinance 2021-3-15A that repeals and reenacts by reference a zoning district map of the Town of Mountain View.

Councilmember Jacobi moved and Councilmember Bailey seconded to approve Ordinance No.

2021-3-15A, an Ordinance repealing and reenacting by reference a zoning district map of the Town of Mountain View,

9. SECOND READING OF ORDINANCE NO. 2021-3-15B, AN ORDINANCE AMENDING SECTION

16-1-132 OF THE MOUNTAIN VIEW MUNICIPAL CODE TO CLARIFY ADMINISTRATIVE ADJUSTMENTS

Mayor Pro Tem Steen reviewed with Council the proposed amendments to Ordinance No. 2021-3-15B, Section 16-1-132.

Councilmember Bailey moved and Councilmember Jacobi seconded the approval of Ordinance No. 2021-3-15B as amended.

Roll Call Vote: Bailey — Yes; Boehrer — Yes; Davis— Yes; Jacobi — Yes. The motion passed.

10. SECOND READING OF ORDINANCE NO. 2021-3-15C, AN ORDINANCE AMENDING ARTICLE 1

OF CHAPTER 13 OF THE MOUNTAIN VIEW MUNICIPAL CODE RELATING TO TRASH CAN LIDS Mayor Levy reviewed with Council the proposed amendments to Ordinance No 2021-3-15C, Article 1 of Chapter 13.

Councilmember Bailey moved and Councilmember Boehrer seconded the approval of Ordinance No. 2021-3-15C as amended.

Roll Call Vote: Bailey —Yes; Boehrer — Yes; Davis —Yes; Jacobi —Yes. The motion passed.

Mayor Pro Tem Steen moved the scheduled Break to after the Council reports from 7:35pm to 7:51pm.

11. COMMITTEE UPDATES

CDOC Committee—The committee referred to its report in the Agenda Packet by updating the Council on the newsletters, food drive and upcoming events. Discussion ensured regarding the events that are scheduled to take place in the summer months.

Sustainability Committee—The committee updated the Council on the trash clean-up event and reported that they did get a Sponsor to help with this event. Bailey and Jacobi thanked Davis for helping get the sponsorship.

12. MAYOR'S REPORT/ITEMS

Mayor Pro Tem Steen had no report.

13. COUNCIL MEMBERS' REPORTS/ITEMS

Councilmember Bailey asked when Council will start meeting in person. Discussion ensued on meeting in person.

14. COUNCIL TO GO INTO EXECUTIVE SESSION PURSUANT TO C.R.S.

Mayor Pro Tem Steen motioned and Councilmember Boehrer seconded to move into executive session for the discussion of a personnel matter under C.R.S. Section 24-6-402(4)(f)(l). She stated that this executive session does not involve discussion of any specific employee that has requested discussion of the matter in an open meeting; any elected official; the appointment of any person to fill an office of this body or of an elected official; or personnel matters that do not require discussion of matters personal to particular employees regarding the Town Attorney. (7:45)

Mayor Levy joined the meeting at 7:37pm.

Councilmember Bailey moved and Councilmember Steen seconded to re-convene to the regular meeting at approximately 8:30pm.

Mayor Levy informed the Council that as of April 19th no one had applied for the vacant Council Member seat so he will be extending the deadline.

15) MEETING TO ADJOURN

Councilmember Boehrer moved and all Councilmembers seconded the motion to adjourn the meeting at 8:35pm.
